Different interpretations have emerged over the Supreme Court’s directions concerning Andhra Pradesh’s municipal elections. Available reports indicate that the Court did not directly extend the nomination deadline across the state. However, it would also be inaccurate to suggest that the Court made no changes to the election process.
Hearing allegations by YSRCP candidates that they were obstructed from filing nominations, the Court directed the State Election Commission (SEC) to defer publication of the final candidates’ list until October 25. It asked the SEC to examine complaints, video clips and other evidence and decide whether nomination deadlines should be extended in specific areas where candidates were unable to file papers because of law-and-order problems.
The Court further directed that if the SEC decides to extend the deadline, affected candidates must receive at least 48 additional hours from the official announcement of that decision. It also ordered police protection for candidates who require it.
Therefore, reports suggesting that the nomination deadline was automatically extended for everyone are misleading. The extension depends on the SEC’s examination of the complaints and its decision regarding the affected areas.
